Provisions of Shanghai Municipality on Science and Technology Awards
(Promulgated by Shanghai Municipal People's Government on March 22, 2001; amended for the first time in accordance with the Decision of Shanghai Municipal People's Government on Amending the Provisions of Shanghai Municipality on Science and Technology Awards promulgated by Decree No. 67 of Shanghai Municipal People's Government on January 11, 2007; amended for the second time and re-promulgated in accordance with the Decision of Shanghai Municipal People's Government on Amending the Provisions of Shanghai Municipality on Science and Technology Awards promulgated by Decree No. 95 of Shanghai Municipal People's Government on December 7, 2012)
Article 1 (Purpose and Basis)
With a view to rewarding the individuals and organizations that have made outstanding contributions in the scientific and technological progress activity of this Municipality, mobilizing the enthusiasm and creativity of scientific and technological workers, accelerating the development of the scientific and technological undertakings of this Municipality, and promoting the development of this Municipality through science and technology, these Provisions are formulated in accordance with the State Regulations on Science and Technology Awards and the Regulations of Shanghai Municipality on Science and Technology Progress.
Article 2 (Establishment of Awards)
The Shanghai Municipal People's Government unifiedly establishes the Shanghai Science and Technology Awards.
Article 3 (Principles of Awards)
Science and Technology Awards carry out the policies of "respecting labor, knowledge, talents and creation", and the judgment on awards follows the principles of "openness, fairness and impartiality".
Article 4 (Establishment and Functions of the Award Committee)
The Shanghai Municipal People's Government establishes the Shanghai Science and Technology Award Committee (hereinafter referred to as the award committee), which shall be responsible for directing and administering the work of science and technology awards of Shanghai Municipality, and examining and deciding on individual and organization winners of the science and technology awards (hereinafter referred to as the winners).
Members of the award committee shall be nominated by the municipal administrative department of science and technology, and reported to the municipal people's government for approval.
Article 5 (Administrative Department and Award Office)
The municipal administrative department of science and technology shall be responsible for the organization and administration work of the science and technology awards of the Shanghai Municipality.
The Shanghai Municipal Administrative Office of Science and Technology Awards (hereinafter referred to as the award office) is the working organization of the award committee set up in the municipal administrative department of science and technology, taking charge of routine administration work of the science and technology awards of the Shanghai Municipality.
Article 6 (Types and Classes of Awards)
Shanghai Science and Technology Awards have six types:
(1) Science and technology meritorious worker award;
(2) Award for the youth making outstanding contributions to science and technology;
(3) Natural science award;
(4) Technical invention award;
(5) Science and technology advancement award; and
(6) International scientific and technological cooperation award.
The science and technology meritorious worker award shall be appraised every two years with the number of winners not exceeding two. The award for the youth making outstanding contributions to science and technology shall be appraised every two years with the number of winners not exceeding 10.
The natural science award, the technical invention award, the science and technology advancement award, and the international scientific and technological cooperation award shall be appraised once a year.
The natural science award, the technical invention award, and the science and technology advancement award are respectively classified into three grades: first-class, second-class and third-class awards. The special award may be given to the citizen or organization that has made extraordinary significant scientific discovery or technological invention, or that has made outstanding contributions to a science and technology task, plan, project of special significance.
Article 7 (Conditions for Evaluation of the Science and Technology Meritorious Worker Award)
The science and technology meritorious worker award shall be conferred on the following science and technology workers:
(1) Those who have made a major breakthrough in contemporary frontier science and technology or made outstanding contributions in the science and technology development; or
(2) Those who have created enormous economic returns or social benefits in science and technology innovations, application of scientific and technological achievements, and industrialization of high technologies.
Article 8 (Conditions for Evaluation of Award for the Youth Making Outstanding Contributions to Science and Technology)
The award for the youth making outstanding contributions to science and technology shall be conferred on the science and technology workers who are under 45 years old on January 1 of the year of making the award application and meet one of the following conditions:
(1) Basic research type: making significant scientific discoveries in the basic research of natural science;
(2) Technology development and industrialization type: making major inventions or key technology breakthroughs in the research of applied technology and industrialization development, or making outstanding contributions in science and technology popularization; and
(3) Enterprise innovation and entrepreneurship type: making outstanding contributions in the new high-tech enterprises' innovation and entrepreneurship in this Municipality and also creating significant economic and social benefits.
Article 9 (Conditions for Evaluation of the Natural Science Award)
The natural science award shall be conferred on the citizens or organizations that expound the natural phenomena, features and laws of nature, making significant scientific discoveries in basic research projects and applied fundamental research projects.
Article 10 (Conditions for Evaluation of the Technical Invention Award)
The technical invention award shall be conferred on the citizens or organizations that make significant technical inventions in products, technology, materials, and systems by applying scientific and technological knowledge.
Article 11 (Conditions for Evaluation of the Science and Technology Advancement Award)
The science and technology advancement award shall be conferred on the following citizens or organizations that make outstanding contributions in the application and promotion of advanced scientific and technological achievements, or the accomplishment of major scientific and technological engineering tasks, plans, or projects, and create marked economic returns or social benefits:
(1) Those who, in implementing technology development items, make significant technical innovations, or transformation of scientific and technological achievements, or industrialization of high technologies;
(2) Those who, in implementing social public interest items, have engaged in fundamental, public and popular work on science and technology for a long period of time, and produce a fairly significant social effect through testing by practice, application and popularization;
(3) Those who, in carrying out major engineering items, make significant technical innovations, ensure that the major engineering project reaches international advance level, or domestic leading level; or
(4) Those who obtain outstanding achievements in soft science projects under scientific and technological management, and decision-making, and exert important influences on governmental policy-making and social development.
The science and technology advancement award named in Item 3 of the preceding clause shall be only conferred on organizations.
Article 12 (Conditions for Evaluation of the International Scientific and Technological Cooperation Award)
The international scientific and technological cooperation award shall be conferred on the following foreigners or foreign organizations that make outstanding contributions to the scientific and technological undertakings in this Municipality:
(1) Those who cooperate with citizens or organizations in this Municipality in carrying out the research and development, and have obtained major scientific and technological achievements;
(2) Those who pass on advanced science and technology to citizens or organizations in this Municipality, or train talents, and have obtained particularly remarkable achievements;
(3) Those who make important contributions in promoting international scientific and technological exchanges and cooperation between this Municipality and foreign nations.
Article 13 (Recommending Units and Individuals)
Individuals and organizations as candidates for the science and technology advancement awards (hereinafter referred to as the candidates) shall be recommended by the following units or experts:
(1) district/county people's governments;
(2) commissions, offices and bureaus under the municipal government; or
(3) other units and experts recognized by the municipal administrative department of science and technology, and having qualification of recommendation.
Article 14 (Procedure of Application)
Recommending units and experts, when recommending candidates for the science and technology advancement awards, shall submit to the award office a letter of recommendation after a uniform form, providing true and reliable materials for evaluation.
Article 15 (Preliminary Examination by Award Office)
The award office shall be responsible for the preliminary examination of the candidates recommended for the science and technology advancement awards, and shall classify those satisfying the conditions according to disciplines and specialties.
Article 16 (Evaluation by Specialized Evaluation Group)
The award office shall, based on results of preliminary examination and classification, organize different specialized evaluation groups to evaluate candidates. The specialized evaluation groups shall propose award grades and make evaluation opinions of specialized evaluation groups.
Article 17 (Publication of Preliminary Evaluation and Handling of Objections)
After specialized evaluation groups make their evaluation opinions, the award office shall publish the preliminary evaluation results through media, and handle relevant objections within 30 days from the publication date. If necessary, forums and hearings may be held to hear opinions from the parties concerned.
The results of handling the relevant objections shall, within 30 days after conclusion of the handling, be sent to individuals or organizations that put forth the objections.
Article 18 (Review, Examination and Approval)
The award office shall, after the publication of preliminary evaluation results and the conclusion of the procedure of handling objections, organize relevant experts to carry out the review.
After the conclusion of the procedure of review, the award office shall submit reports on preliminary examination, evaluation opinions of specialized evaluation groups, publication of preliminary evaluation results, situation of handling objections, and the results of review to the award committee, which shall examine and approve the candidates for awards and grades.
Article 19 (Award of Prize and Publication)
The award committee shall, after examining and approving the candidates for awards and grades, report to the Municipal People's Government for approval in accordance with the provided procedures, and the Municipal People's Government shall issue certificates and premiums to the awarded citizens or organizations, and the list of prize-winners and awards shall be published in the Gazette of Shanghai Municipal People's Government.
Article 20 (Reward Funds)
The premium amounts of the science and technology advancement awards shall be jointly proposed by the municipal administrative department of science and technology and the municipal finance department, and be reported to the municipal people's government for approval.
The reward funds of the science and technology advancement awards shall be charged at the public finance.
Article 21 (Handling of Illegal Acts of Applicants)
Any applicants who cheat the science and technology advancement awards by plagiarizing, imitating or seizing other people's discoveries, inventions, or other scientific and technological achievements or by other deviant means shall have the reward recalled and the premiums retrieved according to law by the municipal administrative department of science and technology.
Article 22 (Handling of Illegal Acts of Recommending Units)
Recommending units that provide false data and materials to help other people cheat the science and technology advancement awards shall be criticized in circular notices by the municipal administrative department of science and technology. Those with serious cases shall have their qualification of recommendation suspended or recalled. Those directly liable person-in-charge or other persons who are directly liable shall be given administrative punishment by their regulatory department.
Article 23 (Handling of Illegal Acts of Evaluators)
Any experts and staff members who resort to deception and malpractice for selfish ends shall have their qualification of participation in the evaluation activity recalled, and shall be criticized in circular notices. The staff members with serious cases shall be given administrative punishment.
Article 24 (Effective Date and Repeal)
These Provisions shall be effective as of April 1, 2001.
The Provisions of Shanghai Municipality on Science and Technology Advancement Reward promulgated by Shanghai Municipal People's Government on December 25, 1985 shall be repealed on the same date.
