Notice of the Department of Commerce of Hebei Province on Further Improving the Foreign Investment Management

The commerce bureaus of all cities (including Dingzhou and Xinji cities) and the economic development zones at and above the provincial level:
For purposes of effectively implementing the spirit of the 5th Plenary Session of the 18th Communist Party of China (CPC) Central Committee and the 12th Plenary Session of the 8th CPC Hebei Provincial Committee, further promoting the reform of the foreign investment management system, further improving foreign investment management and deepening investment facilitation measures, the relevant matters are hereby announced as follows:
I. The scope of the pilot program of fast approval of foreign investment shall be expanded. The scope of the pilot program shall be adjusted to cover the formation, capital increase, equity change, modification of business scope of enterprises in the encouraged or permitted category with a total investment of less than 100 million dollars in the case of formation or a single increase of capital from the formation, capital increase, equity change, modification of business scope of enterprises in the encouraged or permitted category with a total investment of less than 30 million dollars in the case of formation or a single increase of capital. The regions covered by the pilot program and the content and requirements of the pilot program shall remain governed by the requirements of the Notice on Improving Foreign Investment Management and Upgrading Investment Facilitation (No. 10 [2014], Department of Commerce of Hebei Province).
II. The approval power of the formation or modification of foreign-funded commercial enterprises shall be delegated to lower levels. The approval power of the formation of foreign-funded commercial enterprises in the encouraged category, or in the permitted category below the quota, the modification of foreign-funded commercial enterprises that have been formed, and the modification of foreign-funded non-commercial enterprises in respect of expansion of the scope of distribution business shall be delegated to the departments of commerce of the cities (including Dingzhou and Xinji cities) and the economic development zones at and above the provincial level.
III. The approval power of the formation of foreign-funded advertising enterprises shall be delegated to lower levels. The approval power of the formation of foreign-funded advertising enterprises shall be delegated to the departments of commerce of the cities (including Dingzhou and Xinji cities) and the economic development zones at and above the provincial level.
IV. The approval power of the modification of the matters subject to the approval of the Department of Commerce of Hebei Province shall be delegated to lower levels. The approval power of modification of the business scope of the projects subject to the approval of the Department of Commerce of Hebei Province according to the relevant special provisions of the state which does not involve any matter prescribed in the special provisions, the modification of the business scope of the restricted projects subject to approval of the Department of Commerce of Hebei Province which does not involve any matter restricted, and the non-substantive modification of the foreign-funded enterprises which is subject to the approval of the Department of Commerce of Hebei Province shall be delegated to the departments of commerce of the cities (including Dingzhou and Xinji cities) and the economic development zones at and above the provincial level.
This Notice shall come into force on the date of issuance. All localities shall report any problem encountered during the implementation to the Department of Commerce of Hebei Province (Foreign Investment Division) in a timely manner.
