Notice of the Department of Commerce of Hebei Province on Effectively Conducting the Follow-up Work on Delegating to Lower Levels (Authorizing ) the Approval Power of Encouraged Foreign Investment Projects

The commerce bureaus of all cities (including Dingzhou and Xinji cities):
From February 4, 2016, the General Office of the People's Government of Hebei Province issued the Notice of the General Office of the People's Government of Hebei Province on Delegating to Lower Levels a Group of Administrative Power Items (No. 7 [2016], General Office of the People's Government of Hebei Province), authorizing the departments of commerce of all cities (including Dingzhou and Xinji cities) to conduct approval of the formation or modification of encouraged foreign-funded enterprises with total investment of not less than 300 million US dollars not requiring the overall balance of the state. For the purpose of effectively conducting this work, the relevant matters are hereby announced as follows:
I. The competent departments of commerce of all cities shall strictly implement the Catalogue of Industries for Guiding Foreign Investment and other relevant documents, and legally conduct approval of the aforesaid foreign investment projects in strict accordance with the relevant provisions of the state, and shall not expand the approval power and scope.
II. In accordance with the requirements of this Notice, for the aforesaid foreign-funded enterprises formed upon approval of the Ministry of Commerce and the Department of Commerce of Hebei Province, the matters on the modification of such enterprises shall be subject to approval of the competent departments of commerce of the cities in accordance with the law.
III. The departments of commerce of all cities shall waste no time to develop the transition plans, regulate approvals, optimize approval procedures, and specify the time limit for approval, so as to effectively conduct approval of the items delegated to lower levels (authorized).
IV. In order to strengthen interim and ex post supervision, the Department of Commerce of Hebei Province will establish a random check system, and the competent departments of commerce of all cities shall, within five working days of receipt of the notice on random check, submit the approval materials of the enterprises under random check to the Department of Commerce of Hebei Province. The notices of criticism on departments that grant approval illegally shall be circulated, and such departments shall be ordered to take corrective action within a prescribed time limit.
This Notice shall come into force on the date of issuance. All localities shall report any problem encountered during the implementation to the Department of Commerce of Hebei Province (Foreign Investment Division) in a timely manner.
