Provisions on the Administration of Tian'anmen Area of Beijing
(Promulgated by Order No.144 of the Beijing Municipal People's Government on March 18, 2004 and revised by Order No.203 of the Beijing Municipal People's Government on March 31, 2008)
Article 1 These Provisions are formulated for the purpose of maintaining the social order of Tian'anmen Area and strengthening the comprehensive administration of Tian'anmen Area.
Article 2 The “Tian'anmen Area” as mentioned in these Provisions refers to the area from the east of National Museum to the road next to the west side of the Great Hall of the People (not including the western dypass), and from the dypass next to the south side of the Arrow Tower of Zheng Yang Gate to the Meridian Gate of Forbidden City in the north.
Article 3 The Tian'anmen Area Management Committee under the Beijing Municipal People's Government (hereinafter referred to as “Tian'anmen Area Management Committee”) is a dispatched institution of the Beijing Municipal People's Government responsible for organizing and coordinating the relevant departments and the relevant district people's governments to do a good job in the administration of Tian'anmen Area. The public security organ, the city integrated administrative enforcement bureau, the administrative department of commerce and industry and other administrative departments shall do a good job in the daily administration of Tian'anmen Area in accordance with their respective duties and responsibilities.
Article 4 The Tian'anmen Area Management Committee shall establish a supervision and inspection system of the daily administration work of the relevant administrative departments, and organize, coordinate and supervise the relevant departments to do a good job in the comprehensive administration of Tian'anmen Area.
Article 5 The Tian'anmen Area Management Committee shall organize the relevant government departments to formulate the emergency plans for sudden incidents in Tian'anmen Area, establish the emergency commanding system and treatment system, as well as organize emergency rehearsals. The public security organ, the city integrated administrative enforcement bureau as well as other administrative departments shall formulate their own sub-plans according to the emergency plans for sudden incidents in Tian'anmen Area and strengthen training of emergency treatment knowledge and rehearsal of their own working staff.
Article 6 The Tian'anmen Area Management Committee shall do a good job in the provision of services and management in Tian'anmen Area, design uniform commercial and cultural service facilities scientifically and rationally based on the social needs, and set up service marks for the convenience of the people.
Article 7 During the hoist and lowering of the national flag, important activities as well as the festivals and holidays, the public security organ and the city integrated administrative enforcement bureau shall strengthen on-spot patrol and administration of the main passages and other public gathering places where there is a higher probability of congestion or accidents. When people swarm, they shall take measures in a timely manner to guide the people to evacuate.
Article 8 All entities and individuals shall observe the temporary control measures implemented during the hoist and lowering of the national flag, welcome to foreign guests, ceremonies for festivals and other great events and important conferences as well as in the key areas.
Article 9 To hold cultural, sport, entertainment activities and other mass activities, besides handling the relevant procedures according to law, the organizers shall comply with the unified arrangements and administration requirements of the Tian'anmen Area Management Committee. Those carrying out such construction as building roads and public facilities as well as other construction projects shall comply with the integrated administration plan and specific administration provisions on Tian'anmen Area.
Article 10 Those who enter Tian'anmen Area shall abide by laws, regulations and rules, voluntarily maintain the social order in Tian'anmen Area, obey the administration of the relevant working staff, and not carry any of the following articles with themselves:
1. explosive, toxic, radioactive and other dangerous substances;
2. guns, ammunitions, daggers and other control equipment;
3. drugs, pornographic and other prohibited articles; or
4. other articles that will affect social order or public security. The public security organ may carry out checks of persons and vehicles entering Tian'anmen Area.
Article 11 The public security organ, the city integrated administrative enforcement bureau, the administrative department of commerce and industry and other administrative departments shall strictly enforce laws, and impose penalties on those who commit such acts as disturbance of the social order, impairment of the public security, harming of the environment and sanitary condition, destruction of the urban virescence, illegal operation of business and other illegal acts provided for by laws, regulations and rules.
Article 12 Those who, in violation of Article 8 of these Provisions, refuse to observe the temporary control measures shall be persuaded and stopped by the public security organ. Those who refuse to follow the persuasion shall be dealt with by the public security organ according to law.
Article 13 These Provisions shall take effect as of April 20th, 2004.
