The Management Measures of Tianjin Municipality on Underground Space Information was adopted at the 76th Executive Meeting of the Municipal People's Government on September 26, 2011 and is hereby promulgated. It shall come into force as from December 1, 2011.

Management Measures of Tianjin Municipality on Underground Space Information
Article 1 These Measures are formulated in accordance with the Regulations of Tianjin Municipality on Planning and Management of Underground Space in order to normalise management of underground space information, improve the dynamic management mechanism of underground space information, and rationally and effectively tap and utilise underground space resources.
Article 2 These Measures shall apply to the activities of collection, arrangement, utilisation, renewal, maintenance and management of underground space information within the administrative areas of the Municipality.
Article 3 For the purpose of these Measures, the phrase "underground space information" refers to the information produced in the activities of development and construction in the space beneath the earth's surface (including the water surface) of urban planning, control, development and utilisation within the administrative areas of the Municipality. Underground space information includes:
(1) Information on pipelines and their affiliated facilities of city water supply, drainage, gas, electric power, supply of heat, telecommunications, industries, and so on;
(2) Underground facility information including underground communications, people's air defence facilities, and so on;
(3) Information on major underground structures, foundations and their fenders of various kinds of buildings (structures), and
(4) Information on various kinds of water wells, underground source heat pumps (wells), and so on.
Article 4 Underground space information is the important basic data of urban and rural planning, construction and management. The management of underground space information in this Municipality shall follow the principle of centralisation and unification, information-sharing, serving society, and safeguarding safety.
Article 5 The Municipal competent department of urban and rural planning shall be responsible for the unified management of underground space information of the Municipality. Tianjin Information Centre for Underground Space Planning and Management is an institution for daily management of underground space information, responsible for the specific work of collection, arrangement, utilisation, update, maintenance and daily management of underground space information of the Municipality, and responsible for the construction, maintenance, development and utilisation of the comprehensive management system and the sharing platform of underground space information.
Competent departments of urban and rural planning of Binhai New Area, Wuqing District, Baodi District, Ninghe County, Jinghai County, and Jixian County shall be responsible for management of underground space information of their own respective administrative areas, and may commission relevant units to undertake the specific work of underground space information within their respective administrative areas.
Administration departments of development and reform, construction, people's air defence, water affairs, land and housing management, electric power, telecommunications, municipal administration, and so on shall do well their related work within their respective duties.
Article 6 The Municipal competent department of urban and rural planning shall formulate development plans of underground space information of the Municipality in accordance with the actual needs of management of underground space information of the Municipality and shall incorporate them into the related plans of development of information technologies of the Municipality.
Article 7 Construction of the Municipal comprehensive management system of underground space information shall conform to relevant provisions of the state and the Municipality, adopt unified technical standards, and execute dynamic management. .
Underground space information obtained by various related management departments shall be incorporated into the comprehensive management system of underground space information so as to realise the purpose of mutually constructing and sharing information resources.
Article 8 Underground space information is obtained and updated through collection, general investigation, supplementary (updated) survey, and other means.
Article 9 For newly-built, renovated and expanded underground construction projects, their underground space information shall be collected by units undertaking the projects. Units undertaking the projects must collect the following paper medium and corresponding electronic data before planning and acceptance check of the construction projects:
(1) The ichnography, sectional drawing or vertical sectional drawing, transverse section, and other drawing actually surveyed of underground construction projects;
(2) Data thus obtained that reflect the related attributes of underground construction projects; and
(3) Technical reports related to underground space information and reports of engineering survey.
Article 10 For scrapped underground pipelines, underground buildings (structures) and others, their management units, property rights units, or utilisation units, shall collect paper medium and electronic data of related information within 30 days after being scrapped.
Article 11 Collection of underground space information shall adopt the 1990 arbitrary system of rectangular coordinates of Tianjin Municipality, and the 1972 Dagu elevation system of Tianjin Municipality, and accord with the times of elevation as determined by the Municipal competent department of urban and rural planning, and meet the requirement of management technology of underground space information.
The collected underground space information should be true, accurate, and complete, and should not be obliterated and falsified.
Article 12 For newly-built, renovated and expanded underground construction projects, units undertaking the projects shall commission units with corresponding qualifications to conduct synchronic monitoring according to the progress of projects or tracking measurement after completion of projects.
Article 13 Underground space information of the central urban district and the four adjacent districts and underground space information of the cross-districts and –counties shall be submitted to Tianjin Information Centre for Underground Space Planning and Management; underground space information of other districts and counties shall be submitted to the district or county competent departments of urban and rural planning in the localities or to their entrusted units.
Units that accept submission in accordance with the provision of the preceding paragraph are generally referred to as management units of underground space information
Article 14 After receiving the submitted underground space information, management units of underground space information shall conduct examination and verification within five workdays; underground space information that meets the requirement after examination and verification shall be incorporated into the comprehensive management system of underground space information within five workdays and units that submit the information shall be informed thereof; the submitted materials that fail to meet the requirement shall be returned, and re-submitted after revision.
Article 15 Where units undertaking projects survey the present state of underground space, they should commission units with corresponding qualifications to make an on-the-spot survey and draw and submit the results in conformity with the provision of these Measures.
Article 16 The Municipality institutes a system of general investigation for underground space information.
The Municipal competent department of urban and rural planning shall formulate work schemes of general investigation for underground space information based on the needs of planning and construction, and organise for their implementation after approval of the Municipal People's Government.
The Municipal competent department of urban and rural planning shall work out annual plans of supplementary (updated) survey of underground space information based on the actual needs,and management units of underground space information shall organise for their implementation.
Where general investigation for underground space information and activities of annual supplementary (updated) survey involve other management departments or property rights units, management units, utilisation units and units undertaking projects of underground buildings (structures), these related units shall give cooperation.
Article 17 The Municipal,district and county people's governments shall incorporate into financial budget the funds for general investigation for underground space information, annual supplementary (updated) survey, and construction and maintenance of the comprehensive management system of underground space information.
Article 18 If underground space information obtained through general investigation and supplementary (updated) survey meet the requirement after examination and verification, it should be timely incorporated into the comprehensive management system of underground space information.
Article 19 Management units of underground space information shall redouble efforts for updating and maintenance of the comprehensive management system of underground space information, tap and utilise resources of underground space information, and provide information for the Municipal,district and county people's governments and various competent administrative departments to handle public emergencies and disaster prevention and reduction.
Article 20 Projects using underground space for construction should fit in with the planning of underground space. Before drawing up detailed construction plans, proposals of site planning or programmes of public works, units undertaking projects shall consult management units of underground space information for information of the present state of underground space of related areas.
Article 21 Activities of collection, arrangement, utilisation, update, maintenance and management of underground space information shall abide by relevant provisions on secrets of the state and the Municipality.
Article 22 The Municipal, district and county competent departments of urban and rural planning shall strengthen tracking management of underground construction projects, timely follow the progress of engineering construction, and do a good job of supervision and inspection of measurement after completion.
Article 23 Management units of underground space information that provide use of underground space information and related technical consultation and services may charge corresponding fees in accordance with relevant provisions of the Municipality.
Article 24 For those who, in violation of provisions of Articles 9 and 10 of these Measures, fail to submit underground space information, competent departments of urban and rural planning shall order them to submit retroactively within a time limit; if they fail to do so at the expiration of the time limit, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed thereupon.
Article 25 Units that, in violation of the provision of Article 11 of these Measures, submit untrue, inaccurate, and incomplete information shall be subject to corresponding liabilities; where units of survey and draw are involved, competent departments of urban and rural planning shall handle them in accordance with management provisions on survey and drawing.
Article 26 Where units undertaking projects, in violation of the provision of Article 20 of these Measures, arbitrarily organise for construction without checking and obtaining underground space information of the construction area, competent departments of urban and rural planning shall order them to make corrections; where units undertaking projects violate related provisions due to arbitrary organisation of construction, they shall bear related responsibilities pursuant to law.
Article 27 Functionaries of the competent department of urban and rural planning and the management unit of underground space information who abuse their power, neglect their duties, and divulge state secrets shall be given disciplinary punishment according to law; where a crime is constituted, they shall be prosecuted for criminal liabilities pursuant to law.
Article 28 The present Measures shall come into force as from December 1, 2011.
