Announcement on the Formalities for Converting Deposit Ledger “Actual Transfer”
Administration Matters into Customs Affairs Guarantee Items
For the purpose of implementing the relevant requirements of the State Council
for cancelling the bank deposit ledger system for processing trade (hereinafter
referred to as the “deposit ledger”), the handling requirements for the
converting the deposit ledger “actual transfer” administration matters into
customs affairs security matters are hereby announced as follows:
I. After the deposit ledger “actual transfer” administration matters are
converted to customs affairs security matters, the payment of deposit by
enterprises, the amount of deposit, among others, shall be still governed by
Announcement No. 63 [2015] of the Ministry of Commerce and the General
Administration of Customs.
II. Enterprises may handle secured matters in the form of deposit or a letter of
guarantee, etc. For a same secured matter, security shall be posted in the same
form.
III. When handling any secured matter in the form of deposit, an enterprise
shall submit the original letter of guarantee issued by the bank or non-bank
financial institution to the customs office, and the customs office shall issue
a receipt to the enterprise. The security period of the letter of guarantee
shall be 80 days after the expiration of the validity period of the manual.
IV. When the secured matter is handled in the form of deposit, the enterprise
shall pay the deposit in RMB according to the Customs Payment Notice issued by
the customs office and pay the deposit payable to the account of deposits under
the custody as designated by the customs office. After receiving the deposit,
the customs office will issue a Special Customs Deposit Receipt to the
enterprise.
V. If the amount of security increases or the period of security is extended
due to a change in the manual, the customs office shall handle the formalities
of the change of the secured matter for the enterprise in accordance with law.
VI. When the write-off of the manual is concluded, the enterprise may undergo
security refund formalities with the customs office. If security is posted in
the form of a letter of guarantee, the enterprise shall undergo the formalities
of return of the letter of guarantee to the customs office upon the strength of
the letter of guarantee. If security is posted in the form of deposit, the
enterprise shall undergo deposit refund formalities with the financial
department of the customs office upon the strength of the Customs Payment
Notice, the Special Customs Deposit Receipt (the refund page), and the legal
receipts fixed with the financial seal of the enterprise.
This Announcement shall come into force on the date of issuance.
