Notice of the Market Supervision Administration of Xiamen Municipality on Effectively Conducting the Relevant Work of Facilitated Registration of Commercial Subjects in the Xiamen District of China (Fujian) Free Trade Zone

All bureaus of districts; and all departments and offices of and entities directly under the Market Supervision Administration of Xiamen Municipality:
For the purposes of implementing the provisions of the Notice of the Market Supervision Administration of Xiamen Municipality and the Xiamen District Management Committee of China (Fujian) Pilot Free Trade Zone on Issuing the Several Opinions for Serving the Construction of Xiamen District of China (Fujian) Pilot Free Trade Zone (No. 2 [2015], Market Supervision Administration of Xiamen Municipality) on “multiple branches of a bureau for facilitated registration,” and more effectively serving the registration of commercial subjects in the Xiamen District of China (Fujian) Free Trade Zone (“FJFTZ”), the relevant matters are hereby specified as follows:
I. For enterprises domiciled in the district, their registration falls under the jurisdiction of the Market Supervision Administration of the Xiamen District of FJFTZ (hereinafter referred to as the “Administration of the Xiamen District of FJFTZ”) and the registration authority is the Market Supervision Administration of Xiamen Municipality (hereinafter referred to as the “Municipal Administration”). In principle, enterprises in the island area shall be directly registered with the Administration of the Xiamen District of FJFTZ; and enterprises in Haicang District shall be registered with the Administration of Xiamen District of FJFTZ with the assistance of the Administration of Haicang District, and the registration officer shall, when conducting registration of enterprises in FJFTZ, exercise the power of registration jurisdiction of the Administration of the Xiamen District of FJFTZ.
II. Existing enterprises domiciled in the district whose original registration jurisdiction authority is not the Administration of the Xiamen District of FJFTZ may, if they are willing to and so apply, be relocated to be registered with the Administration of the Xiamen District of FJFTZ. To simplify the relocation process, they may directly be relocated from the original registration jurisdiction authority and undergo the formalities of relocation and registration or recordation of change with the Administration of the Xiamen District of FJFTZ.
III. For individual households from Hong Kong, Macao and Taiwan in the district, the registration authority and the registration jurisdiction authority in the island area shall be the “Market Supervision Administration of Huli District of Xiamen City,” they shall be registered by the Administration of the Xiamen District of FJFTZ with the nearest administrations in a unified manner, and the registration officers shall, when conducting registration, exercise the power of registration jurisdiction of the Administration of Huli District; and the registration authority and the registration jurisdiction authority in Haicang District shall be the “Market Supervision Administration of Haicang District of Xiamen City,” and the Administration of Haicang District shall be responsible for registration.
IV. The registration files shall be subject to jurisdictional administration of the registration authorities. The windows completing the specific registration procedure shall effectively collect and review files and deliver them to the file management department in a timely manner.
V. The Administration of the Xiamen District of FJFTZ shall be responsible for the relevant guidance, coordination and other work of commercial registration, and the Administration of Haicang District shall cooperate in the effective completion of specific registration work. The acceptance and reporting of the pre-approval application for the names of enterprises in the district bearing the name of the province shall be under the charge of the Administration of the Xiamen District of FJFTZ in a unified manner. The Enterprise Department, Foreign Investment Department, Haicang District Bureau, and Huli District Bureau of the Municipal Administration shall respectively determine one to two contact persons to handle the commercial registration in FJFTZ.
VI. For the purpose of this Notice, “enterprises” means various foreign-funded enterprises, including enterprises registered a the designated addresses in FJFTZ according to the Notice of the Management Committee of China (Fujian) Free Trade Zone on the Administration of the Registration Domiciles of Commercial Subjects in the Xiamen District of China (Fujian) Free Trade Zone (No. 33 [2015], Xiamen District Management Committee of FJFTZ), and enterprises in all districts whose investment attraction, registration and business operation places are located in the public investment attraction space of FJFTZ according to the Interim Measures for the Administration of Joint Investment Attraction in the Xiamen District of China (Fujian) Free Trade Zone (No. 93 [2015], General Office of the People's Government of Xiamen Municipality). “Island area” means the core area of the cross-strait trade center, including the Northern Airport Area; and “Haicang district” means the core area of the Southeastern International Shipping Center.
VII. This Notice shall come into force on the date of issuance, and shall be valid for two years.
