Preparation of foreign couples for divorce in a Shanghai ourt

 

I. Communicate with the local court and coordinate the court's jurisdiction.

Communicate with the local court and ask whether the court agrees to accept the foreign-related divorce proceedings.

II. Previous preparation stage

A. All documents produced outside China (mainly "marriage certificate") shall be notarized, verified and certified outside China and translated.

B. Issue certificate of current residence

To apply for a certificate of habitual residence which is issued by and stamped with the seal of the property management company or neighborhood committee in a residential area to prove that he/she lives in a certain area and is under the jurisdiction of a people's court of a certain area.

 

To summarize simply the content of the certificate:

This is to certify that XXX, female, Passport No. XXX, from month-date-year to month-date-year has been living in this community. The residence address is: Room X, No. X, District X, Shanghai.

C. If both the husband and wife are "foreign Chinese", they can prepare a copy of household registration information before going abroad to prove their final residence (domicile) in the country before they acquire foreign nationality.

D. The lawyer prepares the case files:

(1) Civil complaint (divorce);

(2) List of Evidence;

(3) Commitment of both parties agreeing to accept the jurisdiction of Shanghai XX district people's court;

(4) Power of Attorney;

(5) Law firms official letter to court.
